THESE TERMS AND CONDITIONS ARE BINDING AND ENFORCEABLE IN TERMS OF SECTION 11(3) OF THE ELECTRONIC COMMUNICATIONS AND TRANSACTIONS (ECT) ACT 25 OF 2002. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST DISCONTINUE USE OF THIS WEBSITE AND OUR CHANNELS IMMEDIATELY.

1. Definitions and Identity

Brisktech refers to BRISKTECH (PTY) LTD, Registration Number: 2026 / 411642 / 07. Throughout this document, “User”, “You”, or “Customer” refers to any person, natural or juristic, accessing our website, communicating with our channels, or purchasing from our platform.

2. User Classification (B2B vs B2C)

  • Consumer (B2C): Individuals or small juristic entities with an annual asset value or turnover under R2 million. B2C transactions are protected by the Consumer Protection Act 68 of 2008 (CPA).
  • Business (B2B): Juristic entities with an annual asset value or turnover exceeding R2 million. CPA protections, including statutory return mandates, do not apply to B2B transactions.

3. Orders, Quotations, and Manifest Errors

  • Stock Availability: All orders and pricing structures are strictly subject to availability from our distribution and wholesale partners.
  • Automated Quotations: By sending documentation or requests to [email protected], you acknowledge that prices are compiled using automated parsing infrastructure. Any quotation generated by our systems constitutes an “Invitation to Do Business” and is never a binding contractual offer.
  • Manifest Errors: Brisktech is not contractually bound by any quotation or order checkout where a manifest database error, LLM calculation error, or pricing misdescription has occurred. We reserve the absolute right to cancel affected orders and issue a full refund.
  • Price Fluctuations: Due to the high volatility of ICT hardware imports, prices fluctuate daily based on international currency values. Prices are subject to change without notice until an order is formally confirmed and accepted by Brisktech.

4. Hardware Specifications & Display Panels

In accordance with international ISO manufacturing standards, a small percentage of sub-pixel anomalies on TFT/LCD/LED panels are deemed acceptable trade tolerances by global brands. Perfect displays cannot be guaranteed, and sub-pixel anomalies falling within standard manufacturer tolerances do not constitute a product defect, nor do they grant grounds for replacement or a refund.

5. Returns, Handling Fees, and “No Fault Found”

  • Return Authorisation (RA): No hardware returns are accepted without a valid Returns Authorisation (RA) number generated by our helpdesk. The RA number must be written clearly on the outer shipping label, not on the original manufacturer packaging.
  • Testing & Diagnostics Fees: All returned hardware is routed to distribution labs for diagnostic assessment. If an item is found to be functional (“No Fault Found”), the item will be shipped back to you at your expense. We reserve the right to levy a reasonable administrative testing fee.
  • B2C Cool-Off Rights: In terms of Section 44 of the ECT Act, Consumer (B2C) users have a 7-day “cool-off” return period from the date of physical delivery. The customer is responsible for the direct transit costs and delivery risk associated with returning the item.
  • B2B Restocking Charges: “Change of mind” or cancellation returns are strictly rejected for Business (B2B) purchases. Any authorized discretionary B2B returns for non-defective hardware carry a mandatory 15% handling and restocking fee.
  • Software Licensing: Digital software keys, subscription provisions, or opened software media are strictly non-returnable and non-refundable under any circumstances.

6. Delivery, Dynamic Rates, and Risk pass

  • Dynamic API Shipping Fees: Shipping costs are calculated directly via the live API of our third-party logistics provider, The Courier Guy. Brisktech does not manipulate or set flat courier fees; you agree to the dynamic pricing calculated based on parcel mass, size, and destination coordinates displayed at checkout.
  • Passage of Risk: Risk passes fully to the User immediately upon physical delivery and courier sign-off at the specified address. Legal ownership of hardware passes only when full cleared payment reflects in our bank account.
  • Transit Damage Notice: You must inspect the external packaging before signing the delivery waybill. Visible box punctures or physical damage must be explicitly logged on the courier’s physical or electronic waybill. Failure to note delivery damage may invalidate subsequent hardware warranty claims.

7. Warranties

All ICT hardware is backed by the standard 12-month limited warranty supplied directly by the manufacturer or authorized South African distributor. Brisktech acts strictly as an administrative facilitator for these corporate warranty claims and does not offer independently funded product warranties.

8. Security and Prohibited Conduct

You may not deliver any malicious code, viruses, or malware payloads to this platform. Any attempt to breach our security infrastructure, execute DDoS procedures, or deploy automated crawlers, scrapers, and spiders for commercial database scraping is a criminal offense under Section 86 of the ECT Act. You indemnify Brisktech fully for any structural infrastructure losses resulting from malicious system actions.

9. Interception of Communications & AI Data Processing

In terms of Section 4 and Section 5 of the Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2002 (RIC Act), you express your unambiguous written consent to Brisktech’s operational right to intercept, read, filter, parse, and monitor all data, emails, and PDF files sent to our servers and communication addresses (including [email protected]). This interception is executed for commercial validation, automated text extraction, system security, and automated quotation rendering purposes.

10. Statutory Disclosures (Section 43 ECT Act)

This legal agreement is deemed concluded in Midrand, Johannesburg, South Africa. It is governed exclusively by the laws of the Republic of South Africa, and all users consent explicitly to the jurisdictional authority of South African high courts in the event of active litigation.
